1. General Provisions

1.1 The following terms and conditions (T&Cs) apply to all contracts concluded via the online shop of Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter: SELLER) under the domain www.morenutrition.de with the customer (hereinafter: CUSTOMER). The contact details of the SELLER are:

1.2 The SELLER does not accept any terms and conditions of the CUSTOMER that differ from these T&Cs. This also applies if the SELLER does not expressly object to their inclusion.


1.3 Only consumers qualify as CUSTOMERS. A consumer is any natural person who places an order for purposes that cannot be attributed to their commercial or independent professional activity.


1.4 The language of the contract is German. If the contract text is translated into another language, the German version shall remain binding.


2. Order Process and Contract Formation

2.1 The display of products in the SELLER’s online shop constitutes only a non-binding invitation to the CUSTOMER to place an order.


2.2 The CUSTOMER may add desired items to the shopping basket by clicking the relevant button and initiate the ordering process by clicking on the basket. During checkout, the CUSTOMER must enter the contact details required for delivery and payment. It is also possible to create a customer account and save order details for future purchases.


2.3 Input errors, including items accidentally placed in the basket, can be corrected by the CUSTOMER by adjusting the quantity in the basket using the available controls. During checkout the CUSTOMER can correct input errors at each step by navigating back and forth using the browser’s “back” and “forward” buttons.


2.4 By clicking the “Buy Now” button, the CUSTOMER submits a binding offer to conclude a purchase contract for the items in the basket. The SELLER will automatically acknowledge receipt of the order immediately by e-mail. This automated acknowledgement does not constitute acceptance of the offer. A contract is only formed when the SELLER accepts the CUSTOMER’s offer by dispatching the ordered goods; receipt of the goods by the CUSTOMER is the decisive moment. The purchase contract with the SELLER is only concluded upon this separate act of acceptance.


2.5 Where an external payment provider is selected, the redirect and completion of the purchase takes place on that provider’s website.


2.6 If the CUSTOMER selects PayPal, credit card, Shop Pay, Apple Pay, Google Pay, Klarna, iDeal (NL), eps (AT) or any other payment method that charges the account immediately, the SELLER implicitly declares its advance acceptance of the contractual offer by making that payment method available at the end of the checkout. Should delivery of the ordered goods prove impossible through no fault of the SELLER, the SELLER reserves the right to withdraw from the contract. Delivery is not possible in particular if the SELLER itself is not supplied by its suppliers through no fault of its own, or if the availability of a product refers explicitly to the SELLER’s stock, which was already sold out at the time of contracting. The SELLER will notify the CUSTOMER immediately and refund any payments already received without delay.

2.7 Orders exceeding quantities typical for private consumption may be refused or cancelled. The CUSTOMER will be notified accordingly.


2.8 By completing the order, the CUSTOMER confirms that they have read and accepted the T&Cs, the privacy policy and the cancellation policy.


3. Amendments

3.1 The SELLER reserves the right to update these T&Cs where necessary. Changes will be communicated to CUSTOMERS in good time and will only take effect with their consent.

 

4. Storage of Contract Text

4.1 The contract text is stored by the SELLER. Order details will be sent to the CUSTOMER separately in text form (e-mail) at the latest upon delivery. The T&Cs can also be accessed and printed in the online shop at https://www.morenutrition.co.uk/pages/terms-of-service.

 

5. Right of Withdrawal

The CUSTOMER has a right of withdrawal in accordance with the statutory provisions.

 

Cancellation Policy

 

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days from the day on which you, or a third party other than the carrier designated by you, take physical possession of the goods.

To exercise your right of withdrawal you must inform us (Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany, e-mail: service@morenutrition.de) by means of a clear statement (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the enclosed model withdrawal form for this purpose, but it is not obligatory. You may also complete and submit the model withdrawal form or any other clear statement electronically via our website. If you make use of this option, we will send you an acknowledgement of receipt without delay (e.g. by e-mail).

 

To meet the withdrawal deadline it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

 

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the cheapest standard delivery we offer), without undue delay and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise; you will not incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal (see Note: Return of Products). The deadline is met if you dispatch the goods before the fourteen-day period has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

6. Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to distance contracts:

  • for the supply of goods that are liable to deteriorate rapidly or whose expiry date would quickly pass;
  • for the supply of sealed goods that are not suitable for return for health-protection or hygiene reasons where the seal has been removed after delivery;
  • for the supply of goods that, after delivery, are by their nature inseparably mixed with other goods.


7. Note: Return of Products

7.1 Goods should, where possible, be returned in their original packaging with all accessories and packaging components to Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany. If the original packaging is no longer available, the SELLER requests the use of suitable protective outer packaging to guard against transport damage. Damage and soiling to the returned goods should be avoided. CUSTOMERS are asked to send physical products to the SELLER as a prepaid parcel and to retain the proof of postage. The cost of returning goods is borne by the CUSTOMER. The SELLER points out that the right of withdrawal and its consequences exist independently of compliance with this note; it is provided solely to facilitate the returns process.

 

8. Prices and Shipping Costs

8.1 The prices valid on the day of the order, as displayed in the online shop, shall apply.


8.2 Prices shown in the online shop are stated in euros and include the applicable statutory VAT.


8.3 The purchase price is due immediately upon conclusion of the contract.


8.4 For goods delivered by parcel or otherwise by post: prices shown in the online shop do not include shipping costs for packaging and postage. Shipping costs are calculated dynamically during checkout and displayed in the basket summary before the order is placed.

9. Payment Terms

9.1 The SELLER only accepts the payment methods offered during the ordering process in the online shop. These are:

  • PayPal
  • Credit card: Visa, Mastercard, American Express
  • eps bank transfer (Austria only)
  • Apple Pay
  • Google Pay
  • Klarna
  • Shop Pay
  • iDeal (Netherlands only)
  • Twint (Switzerland only)

9.2 The CUSTOMER selects their preferred payment method from those available.


9.3 PayPal: If payment is made via PayPal, the CUSTOMER must hold a PayPal account and authenticate with their PayPal credentials. The CUSTOMER must then complete the PayPal payment process and confirm the payment to the SELLER. Payment via PayPal is also possible without a PayPal user account; the terms applicable to the guest checkout function apply. If the CUSTOMER chooses to pay by credit card within PayPal, they may be prompted – depending on the transaction amount or delivery type – to provide a second authentication factor via their card issuer’s website. The CUSTOMER must then verify the payment using their personal second authentication factor such as a password, PIN, TAN or biometric data (e.g. fingerprint or facial scan) via a dedicated app.


9.4 Credit card: When paying by credit card, the CUSTOMER authorises the charge of the full invoice amount including any applicable shipping costs to the relevant card company when entering their card details. At the end of checkout the CUSTOMER is asked to enter their card number, expiry date and security code. Depending on the transaction amount or delivery type, the CUSTOMER may be prompted to provide a second authentication factor via their card issuer’s website. The CUSTOMER must then verify the payment using their personal second factor (password, PIN, TAN or biometric data such as a fingerprint or facial scan) via a dedicated app. The type of identification used depends on the relevant payment service provider (e.g. the CUSTOMER’s card issuer). The charge is initiated with the order confirmation.


9.5 eps bank transfer: If paying by eps, the CUSTOMER must hold an online banking account with one of the participating banks. At the end of checkout the CUSTOMER selects their bank and logs into their online banking area, where they verify the pre-populated payment details. If correct, the CUSTOMER authorises the eps payment to complete the purchase.


9.6 Instant bank transfer (Klarna Sofort): If paying via Klarna Sofort, the CUSTOMER must hold an activated online banking account with a PIN/TAN procedure. At the end of checkout the CUSTOMER is asked to enter their account number, sort code, PIN and TAN into the pre-filled form (bank details, transfer amount, payment reference). The transaction is confirmed to the CUSTOMER immediately afterwards.


9.7 Klarna invoice: In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, the SELLER offers the Klarna payment method. Payment is made to Klarna. Further information is available in the Klarna Terms and Conditions.


9.8 Apple Pay: If paying by Apple Pay, the CUSTOMER pays directly via their Apple account. After submitting the order, the CUSTOMER is redirected to Apple where the payment is authorised. Once the SELLER has been notified of authorisation, the goods are dispatched – subject to the delivery time stated for the item. Depending on the payment method linked to Apple Pay, the charge is applied immediately after authorisation or after dispatch, for the actual invoice amount after any discounts, gift vouchers etc.


9.9 Google Pay: If paying by Google Pay, the CUSTOMER pays directly via their Google account. After submitting the order, the CUSTOMER is redirected to Google where the payment is authorised. Once the SELLER has been notified of authorisation, the goods are dispatched – subject to the delivery time stated for the item. Depending on the payment method linked to Google Pay, the charge is applied immediately after authorisation or after dispatch, for the actual invoice amount after any discounts, gift vouchers etc.


10. Daily100 Subscription

The SELLER offers a limited number of subscriptions for the Daily100 product. The following special provisions apply to these subscriptions:

10.1 The maximum number of available subscriptions is initially limited to 5,000 customers and will be announced at the respective sales launch. Places that subsequently become available may be reallocated on specific dates set and communicated by the SELLER. The SELLER reserves the right to determine the number of subscription places and the availability of waiting-list places at its own discretion.

10.2 Participating CUSTOMERS receive a monthly delivery of the Daily100 product consisting of 28 sachets.

10.3 Payment is due at the beginning of the respective month. The payment methods set out in clause 9 are available to the participating CUSTOMER. Payment via Klarna is excluded.

10.4 The subscription is concluded for an indefinite period and has no minimum term. The notice period for cancellation is two weeks before the end of the respective month. If the participating CUSTOMER does not cancel in time, the subscription renews automatically for an indefinite period. The statutory right of withdrawal remains unaffected.


11. Vouchers, Discounts and Promotions

11.1 Gift vouchers: these are vouchers that can be purchased by the CUSTOMER. The value is chosen by the CUSTOMER from the options listed on the homepage. The value can be applied across multiple orders until fully used. Gift vouchers are valid for three (3) years for purchases in Germany, and five (5) years for purchases in Austria and Switzerland respectively. To redeem, enter the voucher code in the designated field before completing the order. The stored amount is deducted from the order value. Any remaining balance is retained and can be redeemed on the next order by entering the code again. Orders exceeding the voucher value can be settled using the available payment methods.


11.2 Value vouchers: these are vouchers for a specific purchase value issued exclusively by the SELLER to the CUSTOMER, e.g. as a goodwill gesture. They are personal, non-transferable and cannot be purchased. Cash redemption is not possible. Value vouchers are valid for one (1) year from the date of issue. To redeem, enter the code in the designated field before completing the order. The stored amount is deducted from the order value. Any remaining balance is retained and can be redeemed on the next order. Orders exceeding the voucher value can be settled using the available payment methods.


11.3 Product vouchers: these are vouchers for a specific product issued exclusively by the SELLER to the CUSTOMER, e.g. as a goodwill gesture. They are personal, non-transferable and cannot be purchased. Cash redemption is not possible. Product vouchers are valid for one (1) year from the date of issue. To redeem, enter the code in the designated field before completing the order. The specified product is added to the order free of charge.


11.4 Discount codes: By entering a discount code during checkout, the CUSTOMER receives a specified discount for the stated period on individual products, product groups, quantities, the order total or shipping. Discount codes cannot be purchased; they are issued by the SELLER with a defined validity period. A discount code may be redeemed once in the basket before completing the order; retrospective application is not possible. Multiple discount codes cannot be combined with each other, but a discount code may be combined with a voucher during checkout. Discount codes can be combined with gift vouchers.

Mehrere Rabattcodes können nicht miteinander kombiniert werden, aber eine Kombination von Rabattcodes mit Gutscheinen ist im Bestellvorgang möglich. Eine Kombination von Rabattcodes mit anderen Rabattcodes ist nicht möglich. Rabattcodes können jedoch mit Geschenkgutscheinen kombiniert werden.

 


11.5 The minimum order value for gift promotions refers to the lowest value that must be reached after deducting any returns. If the minimum order value is not met due to a full or partial withdrawal, the gift must be returned to the SELLER.


12. Deal-Sharing Platforms

12.1 The SELLER reserves the right to exclude BUYERS who are directly or indirectly associated with or actively use deal-sharing platforms from participating in promotions, challenges and advertising campaigns.

 

13. Delivery and Shipping Terms – Information on Calculating the Delivery Date

13.1 Goods delivered by parcel or otherwise by post will, unless otherwise agreed with the CUSTOMER, be dispatched by post (parcel, packet, letter, freight carrier, etc.) to the delivery address provided by the CUSTOMER in the order.


13.2 The delivery time is stated separately for each item in the product description on the item page.


13.3 For payment methods where the CUSTOMER is charged immediately upon placing the order, the SELLER initiates delivery directly after receipt of payment. For all other payment methods, the delivery time stated on the item page begins on the working day following the date of contract conclusion.


13.4 Orders may be placed by all CUSTOMERS from the European Economic Area and, where applicable, the additional countries listed in the online shop and/or the shipping cost table. Delivery is only made to Germany and the countries listed in the online shop and/or the shipping cost table. The full product range cannot be shipped to all countries.


13.5 If the carrier returns the goods to the SELLER because delivery to the CUSTOMER was not possible, the CUSTOMER bears the cost of re-delivery. This does not apply if the CUSTOMER exercised a right of withdrawal alongside the refusal to accept delivery, or if the CUSTOMER is not responsible for the circumstances that made delivery impossible, or if the CUSTOMER was temporarily prevented from accepting the goods, provided the SELLER had not given the CUSTOMER reasonable prior notice of the delivery.

14. Refunds

14.1 Any refunds will be processed automatically by the SELLER to the payment method used by the CUSTOMER. For invoice payments, the refund is made to the account from which the transfer was made. If the CUSTOMER paid via an external payment provider, the refund is made to the associated account. If the CUSTOMER used a value voucher for their purchase, the corresponding amount will be credited to their voucher account.

 

15. Retention of Title

15.1 The SELLER retains ownership of the sold goods until the purchase price has been paid in full.

 

16. Warranty / Liability for Defects

16.1 In the event of defects in the purchased goods, the CUSTOMER’s rights against the SELLER are governed by the applicable statutory provisions.

 

17. Customer Account

17.1 The CUSTOMER may create a customer account in the online shop free of charge.


17.2 When creating a customer account, the CUSTOMER is asked to provide their personal data in accordance with the SELLER’s privacy policy. By providing their data, the CUSTOMER warrants that it is genuine and accurate, and undertakes to keep it up to date when placing orders. Any additional shipping costs incurred by the SELLER due to incorrect or inaccurate data will be charged to the CUSTOMER. After requesting account creation by clicking “Create”, the CUSTOMER receives an e-mail.


17.3 By clicking on the link contained therein, the CUSTOMER confirms their identity and receives a confirmation of the creation of their customer account by e-mail.


17.4 The CUSTOMER is only permitted to register and maintain one customer account at any given time. If the SELLER becomes aware of multiple registrations, the SELLER is entitled to exclude the CUSTOMER from using the online shop. CUSTOMERS whose account has previously been blocked or terminated by the SELLER may not create a new account. Minors may not register.


17.5 Both the CUSTOMER and the SELLER may terminate the customer account contract at any time with immediate effect without giving reasons. The SELLER reserves the right to delete registrations of CUSTOMERS who have provided incomplete or incorrect data.


18. Customer Service

18.1 Any order-related enquiries can be submitted by CUSTOMERS or interested parties via the Help Centre. The CUSTOMER or interested party may submit their enquiry via the Help Centre contact form and will subsequently be contacted by the SELLER at the e-mail address provided in the contact form.

 

19. Data Storage and Privacy

19.1 Only the data protection provisions of the privacy policy at https://morenutrition.co.uk/pages/privacy-policy shall apply.

 

20. Alternative Dispute Resolution

20.1 The SELLER is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

21. Final Provisions

21.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).


21.2 The above choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the CUSTOMER has their habitual residence.
