Conditions of participation for the newsletter competition of Quality First GmbH

1. Subject of the Terms of Use and Participation

1.1. Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter referred to as the “Organizer”) is organizing a newsletter competition (hereinafter referred to as the “Competition”) via its online shop (hereinafter referred to as the “Online Shop”) to promote its products.

1.2. These terms and conditions govern the conditions for participation in the competition and any necessary transfer of rights.

2. During which period can I participate in the competition?

2.1. The participation period is four weeks from the initial publication in the online shop via a pop-up window. One winner will be drawn weekly and notified immediately after the draw.

2.2. The organizer reserves the right to extend the participation period by posting a corresponding notice on morenutrition.de. Should the participation period be extended, the further prize processing may change.

3. Who can participate in competitions?

3.1. Any natural person who is at least 18 years old, residing in Germany, Austria or Switzerland and has a valid email address may participate in the competition.

3.2. Each participant is only entitled to participate once. Furthermore, only those who have not previously won a prize are permitted to participate.

3.3. By participating in the competition, you accept these terms and conditions.

4. How do I participate in the competition?

4.1. Participation in the competition is free of charge and is governed exclusively by these terms and conditions.

4.2. Participation in the competition requires successful registration for the organizer’s newsletter.

4.3. All participants in the competition who meet the requirements set out in clauses 3 and 4 by the time of the draw will be considered.

4.4. After the entry deadline has expired, the winner will be selected by the organizer from among all eligible participants. The winners will be randomly drawn.

4.5 The winner will be notified by email.

4.6. Each notified winner is obliged to inform us within 2 days of being contacted, stating their email address, whether they accept the prize.

4.7 If it is not possible to contact the winner or the organizer does not receive a corresponding message within this period, the opportunity to accept the prize will expire and the organizer reserves the right to select another participant and notify them accordingly.

4.8. If the winner's contact details (e.g., email address or postal address) are incorrect or inaccurate, the Organizer is not obligated to verify the correct information. Any disadvantages resulting from providing incorrect contact details (e.g., non-delivery, return, etc.) are at the winner's expense.

5. What are the prizes?

5.1. A voucher for the Organizer's online shop worth up to €1,000.00 will be raffled once (1) per week for a total of four (4) weeks (hereinafter "Prize").

5.2. The vouchers (or voucher codes) will be sent by email.

5.3 Cash payment, exchange or transfer of prizes (both vouchers and non-cash prizes) is excluded for all competitions.

5.4. The Organizer shall only be liable for damages incurred by the winner due to material and/or legal defects in the event of malice, intent, or gross negligence. Otherwise, liability for material and/or legal defects is excluded.

5.5. Each winner is responsible for any taxation of the prize.

6. Who can be excluded from the competition?

6.1. A violation of these terms and conditions entitles the organizer to exclude one or more participants from participating in the competition. This applies in particular if false information is provided or third-party rights (personal rights/copyrights) are violated.

6.2. In addition, the organizer may exclude individual or multiple participants from participating in the competition if the participation process and/or the competition website is manipulated or attempted to be manipulated and/or these terms and conditions are violated and/or if there is any other unfair and/or improper attempt to influence the competition or its execution, particularly by disrupting the software used. In these cases, prizes may also be revoked and reclaimed retroactively.

6.3 Persons who do not meet the requirements set out in clauses 3 and 4 are excluded from participation.

6.4. Employees of the organizer or an affiliated company as well as other persons involved in the development and implementation of these competitions are excluded from participation.

7. Early termination, adjustment or modification of the competition

7.1 The organizer is entitled to terminate, adapt or modify the competition at any time without prior notice and without giving reasons if the proper conduct of the competition cannot be guaranteed for technical or legal reasons without appropriate measures.

8. How is my data processed?

8.2. The organizer processes the data only for the purpose of conducting and processing the competition in accordance with Art. 6 (1) (b) GDPR. Subject to statutory retention periods, the data provided as part of the competition will be deleted if the purpose for which they were processed no longer applies or if they are no longer required for that purpose.

9. Severability Clause

9.1 Should individual provisions of these Conditions of Participation be or become invalid, the validity of the remaining Conditions of Participation shall remain unaffected.

9.2 Legal recourse is excluded.

9.3. German law applies and the UN Convention on Contracts for the International Sale of Goods is excluded.
