Conditions of participation for the “Golden Scoop” promotion of Quality First GmbH

1. Subject of the terms and conditions of use and participation

1.1 Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (“Organizer”) sells its own products via the following online stores morenutrition.de (“Onlineshop-DACH”), nl.morenutrition.com (“Onlineshop-NL”) and morenutrition.co.uk (“Onlineshop-UK”; Onlineshop-DACH, Onlineshop-NL and Onlineshop-UK together also referred to as the “Online Shop”).
1.2 The Organizer organizes the “Golden Scoop” promotion (“promotion”) via its Instagram accounts morenutrition.de (“Instagram-Account-DACH”), morenutrition.nl (“Instagram-Account-NL”) and morenutrition.uk (“Instagram-Account-UK”; Instagram-Account-DACH, Instagram-Account-NL and Instagram-Account-UK collectively also referred to as “Social Media Presence”) to promote its own products.
1.3 The promotions organized by the Organizer on the Social Media Presence are not affiliated with Meta Platforms Inc. and its affiliates and are not the responsibility of, sponsored, supported or organized by Meta Platforms Inc. and its affiliates. All questions, comments, notices and complaints regarding the Contests should be addressed to the Organizer and not to Meta Platforms Inc.
1.4 These Terms and Conditions govern the conditions for participation in the Contest and any necessary transfer of rights.
1.5 The organizer expressly points out that the “Golden Scoop” is not a spoon made of a precious metal (e.g. gold). The “Golden Scoop” is merely a visualization. The actual prize is the voucher described in more detail in section 5. The “Golden Scoop” is not suitable for use with food, as it is a dummy sprayed with gold spray paint.

2. During which period can I participate in the promotion?

2.1 The participation period of the promotion is from 02.03.2025 at 11.00 am (CET) to 09.03.2025 at 10.00 am (CET) (“participation period”).
2.2 The Organizer reserves the right to extend the Participation Period by means of a corresponding notification on its social media presence. If the participation period is extended, it is possible that the further prize processing will change.

3. Who can take part in the promotion?

3.1 Any person who is at least 18 years old and resides in Germany, Austria, Switzerland, the Netherlands or the United Kingdom, in each case excluding the extra-European territory, may participate in the promotion (“Participant”).
3.2 Each participant is only entitled to take part in the promotion once. Participation by the same person using different names or e-mail addresses is prohibited and entitles the organizer to exclude the participant from the competition. Furthermore, only persons who have not yet received a prize may participate.
3.3 By participating in the promotion, the participant accepts these conditions of participation.

4. How does participation in the promotion work?

4.1 During the participation period, the organizer will add a total of ten (10) “Golden Scoops” including a printed voucher at random among all orders of products from the “Proteins” category (“Protein Products”) received via the online store during this period.
4.2 Protein products include: More Protein, Vegan More Protein, More Protein Iced Coffee, Vegan More Protein Iced Coffee, More Clear Protein, More Sauces & Back Protein, More Protein Iced Latte, More Protein Milkyccino, More Clear Glow Peptides, More Protein Iced Matcha Latte.
4.3 If the participant places an order containing a protein product during the participation period, they have the chance to win a “Golden Scoop” including a voucher in accordance with section 5. It should be noted once again that this is not a spoon made of a precious metal (e.g. gold), but merely a visualization of the prize.

5. What prizes are there and how can they be redeemed?

5.1 The “Golden Scoop” is merely a visualization. The actual prize is a voucher for the Organizer's online stores listed above in the amount of EUR 800.00 (“Prize”).
5.2 To redeem the prize, the participant must enter the printed voucher code at check-out in the respective online store of the organizer. In the case of online stores with a different currency (e.g. British pounds in the UK online store), the value of the prize will be automatically deducted from the winner's shopping cart at the current exchange rate.
5.3 The prize is valid for a period of three (3) years and can be redeemed by the participant in several transactions until the total value is reached.
5.4 Cash payment, exchange or transfer of the prize is excluded.
5.5 The Organizer shall only be liable for damages incurred by the winner due to material defects and/or defects of title in the event of malice, intent or gross negligence. Otherwise, liability for material defects and/or defects of title is excluded.
5.6 Each winner is responsible for any taxation of the prize.

6. Who can be excluded from the competition?

6.1 A breach of these conditions of participation entitles the organizer to exclude one or more participants from taking part in the competition. This applies in particular if false information is provided or the rights of third parties are violated (personal rights/copyrights).
6.2 In addition, the organizer may exclude individual or several participants from participation in the competition if the participation process and/or the platform is manipulated or manipulation is attempted and/or these conditions of participation are violated and/or other unfair and/or dishonest attempts are made to influence the competition or the handling of the competition, in particular by interfering with the software used. In such cases, prizes may also be subsequently withdrawn and reclaimed.
6.3 Persons who do not meet the requirements set out in sections 3 and 4 are excluded from participation. Employees of the organizer or an affiliated company and other persons involved in the development and implementation of this competition are excluded from participation.

7. Premature termination, adjustment or modification of the competition

7.1 The organizer is entitled to terminate, adapt or modify the competition prematurely at any time without prior notice and without giving reasons if the proper execution of the competition cannot be guaranteed without appropriate measures for technical or legal reasons.

8. How will my data be processed?

8.2 The organizer processes the data only for the execution and handling of the competition in accordance with Art. 6 para. 1 lit. b GDPR. The personal data provided in the context of the competition will be deleted - subject to statutory retention obligations - if the purpose of processing this data no longer applies or if it is not required for the purpose.

9. Severability clause

9.1 Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
9.2 Legal recourse is excluded.
9.1 More favorable standards of the law applicable at the participant's usual place of residence shall take precedence. In all other respects, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
